Start with the person doing the job, the cover you need and the way they will work with your team.

**The short answer.** You can appoint an outsourced data protection officer, or DPO, through a service contract. The same duties and protections apply as for an employee in the role. Check expertise, independence, time and access to senior management before comparing the fee ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

## What does an outsourced DPO do?

A DPO advises on data protection, monitors how the organisation follows the rules and helps with assessments of risky uses of data. They are also a contact for the regulator. Appointing one does not move responsibility for compliance away from your organisation ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

The role needs expert knowledge of data protection law and practice. It also needs enough time and resources to work. A title on a contract cannot do those jobs on its own ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

**Who does what?**

- **Your organisation**: Takes responsibility for following the rules.
- **The DPO**: Advises, monitors and acts as a contact for the regulator.

Your organisation keeps responsibility for how it uses data.

## What should you ask an outsourced DPO firm?

Use the same questions for each firm. You are looking for a service that can do the work and remain independent. The DPO must be accessible to staff, the public and the regulator ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

**Questions for a first conversation**

| Ask | What you are trying to establish |
| --- | --- |
| Who will be our DPO, and who covers an absence? | A clear contact and enough support for the role. |
| What relevant data protection experience do they have? | Expertise suited to the work. |
| How much time is included? | Enough time for the duties. |
| How will they reach senior management? | Independent access to the highest management level. |
| What other work will they do for us? | Whether another role could create a conflict. |
| Which duties and extra tasks does the fee cover? | A shared understanding of the service. |

## How do you check independence?

A DPO must not hold another role that decides why or how personal data is used. Otherwise they can end up checking decisions they made themselves. Ask the firm how it checks this before accepting the appointment ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

The DPO must be able to report to the highest management level. Agree who that is in your organisation and how the DPO will raise concerns with them ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

## Can an outside team provide the role?

Yes. The contract can be with an individual or an organisation. A single DPO can also be supported by a team with specialist skills. Ask who takes the role and how the rest of the team supports it ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

If you choose to appoint a DPO voluntarily, the same rules about their position and duties apply. Check whether you need a DPO before buying a service with that title ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

## What to do

1. Check whether you need a DPO or are choosing to appoint one voluntarily ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).
2. Write a short list of the work and support you want.
3. Ask each firm about expertise, conflicts, time and senior access ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).
4. Put the agreed service and contact arrangements in the contract ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

## Common questions

### Can our DPO be a company rather than an employee?

Yes. You can use a service contract with an individual or an organisation. The role has the same duties and protections ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

### Does hiring a DPO pass our legal responsibility to them?

No. Your organisation remains responsible. The DPO is not personally responsible for the organisation’s compliance ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).

### Can a team help the DPO?

Yes. A single DPO can be supported by a team with specialist skills ([ICO, Data protection officers](https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/accountability-and-governance/guide-to-accountability-and-governance/data-protection-officers/), checked 7 October 2026).
